EU 261/2004 Compensation application
Dear Passenger
If you are denied boarding or if your flight is cancelled or delayed for at least 2 hours, you are entitled to certain rights under regulation (EC) No. 261/2004 of the European Parliament and of the Council of 11 February 2004.
Scope
The regulation applies to passengers departing from an EU airport or from an airport in a third country with an EU airline to an airport within the EU.
The regulation does not apply, if the incident was (i) due to justifiable reason, e.g. health reasons, inadequate travel documents etc., or (ii) caused by extraordinary circumstances, such as, but not limited to, adverse weather conditions, strike, air traffic congestion in the airspace and/or airport, political instability, bird strike etc., which could not have been avoided, even if all reasonable measures had been taken.
Delays
An expected delay of 4 hours for flights of more than 3500 km, 3 hours for flights between 1500 km and 3500 km and all intra-Community flights (EU countries and Norway, Switzerland and Lichtenstein) of more than 1500 km, and 2 hours for flights up to 1500 km entitles you to receive care while waiting, including meals and refreshments reasonable in relation to the waiting time, and potentially hotel accommodation if relevant.
Care for passengers awaiting an alternative or delayed flight may be limited or denied if the provision for care would cause a further delay.
Delays of 5 hours or more entitle you to cancel the flight and receive a refund of the value of the flight within 7 days. The refund is limited to the cost of the flight ticket in respect of the specific delayed flight and thus not the paid fee of the entire travel package. Should you choose to cancel the flight, the right to receive care pursuant to the above will cease.
If your flight is delayed and the time of arrival at your final destination is 3 hours or more, you are entitled to receive compensation as Denied boarding or Cancellation.
Denied boarding
If you are involuntarily denied boarding on a flight for which you hold a valid reservation due to overbooking, you are entitled to care and the same refund as Delays and the compensation below.
Subject to the availability of seats, you are also entitled to a re-routing, under comparable conditions, to your final destination at the earliest opportunity.
If you volunteer not to board the flight, you are entitled to the same refund as Delays and the compensation below.
The compensation is payable in cash, cheque or via bank transfer or, subject to your consent, in the form of vouchers.
The compensation amounts to (i) €250 for flights up to 1500 km, (ii) €400 for flights between 1500 km and 3500 km and for all intra-Community flights of more than 1500 km, and (iii) €600 for flights of more than 3500 km.
If you are offered an alternative flight which is scheduled to arrive at your final destination within (i) 2 hours for flights up to 1500 km, (ii) 3 hours for flights between 1500 km and 3500 km and all intra-Community flights of more than 1500 km, and (iii) 4 hours for all other flights, the above-mentioned compensation may be reduced by 50 %, i.e. €125, €200 and €300.
Cancellation
If a flight, for which you hold a valid reservation, is cancelled, you are entitled to care, a re-routing and/or a refund and the compensation as Denied boarding. Compensation does not apply, if you have been informed of the cancellation, (i) at >14 days before the scheduled time of departure; (ii) between 14-7 days before the scheduled time of departure and the alternative flight departs no more than 2 hours before the originally scheduled time of departure and arrives at the final destination less than 4 hours after the originally scheduled time of arrival; (iii) <7 days before the scheduled time of departure and the alternative flight departs no more than 1 hour before the originally scheduled time of departure and arrives at the final destination less than 2 hours after the originally scheduled time of arrival.
